RULES ON ENSURING OBSERVANCE OF THE PUBLIC ORDER ON THE TERRITORY OF THE SKI RUNS IN THE SKI AREA OF PAMPOROVO RESORT
Chapter one
GENERAL PROVISIONS

Art. 1. These rules regulate the social relations related to ensuring the observance of the public order on the territory of the ski runs in the ski area of Pamporovo Resort.

Art. 2. (1) When using the ski runs in the ski area of Pamporovo Resort, each person shall comply with these Rules, the General Terms and Conditions for provision of services and the Rules on using the ski runs and ski lifts on the territory of the ski area in Pamporovo Resort of the person under Art. 157, paragraph 1 of the Tourism Act, the compulsory rules for safe conduct of the tourists who use ski or snowboard, as well as the compulsory instructions by the officials, appointed by the Mayor of Smolyan Municipality or the Mayor of Chepelare Municipality, the ski patrol and the bodies of the Ministry of Interior, which are responsible for ensuring the observance and control of the public order and safety on the ski runs.

(2) The users of services in the ski area of Pamporovo Resort shall be personally responsible for observing these Rules and shall practice winter sports (ski, snowboard, etc.) on the territory of the ski runs and use the facilities that service them (passenger rope-ways) at their own risk.

(3) In case of a failure to comply with these Rules, the non-performing persons shall be penalized in accordance with Chapter seven "Administrative Penalties" herein.
Chapter second
RULES FOR SAFE USE AND CONDUCT ON SKI RUNS

Art. 3. (1) The territory of the ski runs in the ski zone of Pamporovo Resort shall be accessible for each tourist who wishes to practice winter sports (ski, snowboard and cross-country) or be instructed by certified ski instructors, during the working hours, officially announced by the person under Art. 157, paragraph 1 of the Tourism Act.

(2) On the territory of the ski area of Pamporovo Resort:

1. skiing/snowboarding along the ski runs out of official working hours is forbidden;

2. riding mountain bikes along the ski runs is forbidden;

3. incorrect use of the ski runs, incl. by passers-by, sleds, as well as for take-off and landing of hang gliders and paragliders from sites not designated for this purpose, is forbidden;

4. using the rope-ways and/or skiing/snowboarding on the ski runs by individuals who are visibly under the influence of alcohol and/or other drugs is forbidden;

5. It is not allowed and/or you shall be prevented from driving motor vehicles or other equipment, different from ski or snowboard, including after closing of the runs and after ending their operation, with the exception of equipment used by the person under Art. 157, paragraph 1, of the Tourism Act, for processing of the ski runs, securing the order and safety along the ski runs or in the event of an emergency situation, as well as equipment used by the persons engaged in mountain rescue and/or medical teams which need to realize the activities described in Art. 2, paragraph 7 of the Ordinance, with the required signaling, in accordance with Art. 2, paragraph 6, item 1-4 inclusive, and Art. 12 of the Ordinance;

6. Rescue activities shall be carried out by the Mountain Rescue Service at the Bulgarian Red Cross (BRC).

Art. 4. The users who practice ski or snowboard (and in case they are minors or underage – their parents or attendants) shall bear the personal responsibility and the risk of using the passenger rope-ways, also when skiing/snowboarding on the ski runs in the ski area of Pamporovo Resort. Before starting to use the services provided in the ski area, each customer shall assess their own psychological and physical condition at the time, the specific snow/climate conditions, whether they are in good condition and have the necessary level of skill for performing the respective actions – skiing/snowboarding on the ski runs in the ski area and/or using the adjoining rope-ways (chair lifts and tow-lifts), as well as make an obligatory assessment of their readiness to take the risks related to the practicing of winter sports and the use of the passenger rope-ways.

Art. 5. (1) Each user who practices ski or snowboard in the ski area of Pamporovo Resort shall read and comply with the Rules on Safe Conduct as follows:

1. they shall take into consideration other users who practice winter sports, and their behavior on the ski runs and while using the rope-ways shall not endanger or harm the life and health of other skiers/snowboarders;

2. they shall use only the designated and open ski runs and shall comply with all markings and signs; they shall use ski runs which correspond to their technical and physical skills; skiing out of the designated ski runs and out of working hours, as well as failure to observe the notices for closed ski runs and/or sections thereof by the person under Art. 157, paragraph 1 of the Tourism Act, shall be done at each skier/snowboarder's own risk.

3. they shall conform their speed and the way they move to their abilities, the conditions of the terrain, the snow cover, the weather conditions and the traffic intensity; their shall not endanger or pose difficulties to the other skiers and snowboarders; they shall have full control of their ski/snowboard, so that if necessary they can be able to change their direction or stop;

4. they shall decrease their speed in sections with reduced visibility, close to building sites and/or obstacles, at intersections, at crossings, in case of fog, in case of intense traffic, at narrow sections and/or if there are beginner skiers;

5. They shall be responsible for their behavior on the ski run and for the good condition of their equipment.

(2) Each user who practices ski or snowboard in the ski area of Pamporovo Resort shall comply with the following traffic rules on the ski run:

1. all skiers and/or snowboarders that ski ahead have the right of way compared to those behind them; skiers/ snowboarders coming from behind shall not endanger in any way those before them and for this purpose they shall keep appropriate distance;

2. upon overtaking on the ski run, the overtaking skier/snowboarder shall ensure sufficient space for each voluntary or involuntary movement of the skier/snowboarder being overtaken; the skier/snowboarder who is overtaking shall be fully responsible for making the maneuver in a way that does not pose difficulties to the one being overtaken, and this shall be done until completing the maneuver, as well as in the cases when overtaking skiers/snowboarders who have stopped;

3. stopping at narrow sections of the ski run or at places with reduced visibility shall be admissible only as a last resort, whereas the skier/snowboarder who has stopped shall move as soon as possible to a safe place; after stopping, reentry into traffic along the ski run shall be made only in a safe way, without any risk of collision;

4. after falling on the ski run, the skier/snowboarder shall move to a safe place, as fast as possible;

5. at crossings, the right of way shall be for the one coming from the right;

6. in case it is necessary to move opposite the normal direction of traffic, as well as climbing or descending without ski/snowboard shall be done at the side of the ski run;

7. they shall yield the right of way to the ski patrol, ski police and the rescue services, as well as to the authorized motor vehicles, and they shall not obstruct their passing in any way;

8. in the event of accident on the ski runs, they shall safeguard the injured and shall inform immediately the ski patrol and the mountain rescue service of the accident, and they shall give their name and address;

9. if necessary, they shall yield the right of way to the officials, ski patrols, ski police and the rescue services upon their getting on the lifts and tow-lifts;

10. they shall move as fast as possible away from the ski run, make way for and in no way obstruct the passing of the motor vehicles for processing of ski runs, of snowmobiles and other vehicles used by the persons who ensure the order and safety at the ski runs in case of emergency situations, as well as by the persons participating in mountain rescue and/or medical teams.

Art. 6. (1) Special rules of conduct for cross-country:

1. cross-country tracks shall be used only one-way; when as an exception a two-way movement is necessary, it shall be obligatory to place separator nets and fences;

2. in cross-country, the slow runners shall move at the right side of the ski run;

(2) The rules under the previous Article shall also be observed by the ski runners, provided they do not contradict to the rules under paragraph 1 of this Article.

Art. 7. Night-time skiing under artificial lighting along the ski runs in the ski area of Pamporovo Resort shall be allowed upon observing special rules, determined by the person under Art. 157, paragraph 1 of the Tourism Act, which shall be announced in a suitable and accessible for the people practicing ski and snowboard way.

Art. 8. Practicing of hang-gliding, paragliding, speedriding, kiting and kiteboarding, as well as tobogganing in the ski area of Pamporovo Resort shall be allowed only if the person under Art. 157, paragraph 1 of the Tourism Act considers it compatible with the designation of the ski runs and upon compliance with special rules, which have been announced by it in a way that is suitable and accessible for the people practicing these sports.
Chapter three
TRAFFIC RULES FOR MOTOR VEHICLES

Art. 9. (1) In order to ensure the safety, security and tranquility in the ski area of Pamporovo Resort:

1. it is not allowed to use motor vehicles and/or other mobility equipment as scooters, ATVs, snowmobiles and non-motorized sledges, mountain bikes, sled-bikes, ski-bikes, dog-sleds, etc. on the territory of the ski runs, including after their closing and/or after finishing their operation for the respective winter season, which are different from ski or snowboard, with the exception of the motor vehicles in the cases under Art. 151, paragraph 4 of the Tourism Act;

2. Incorrect use of the ski runs, including by people wearing snowshoes, as well as for take-off and landing of hang gliders and paragliders, is forbidden.

3. Movement (waiting and descending) along the ski runs of pedestrians shall be made in a safe way, and it shall be done away from the ski run.

(2) Owners and/or users of snowmobiles shall observe the routs, times and safety traffic rules, determined by an order of the Mayor of Chepelare Municipality and the Mayor of Smolyan Municipality.

(3) The bans under paragraph 1, item 1 shall not apply to motor vehicles for maintenance and processing of ski runs, for ensuring the order and safety at the ski runs in case of emergency situations, as well as vehicles used by the persons participating in mountain rescue and/or medical teams, provided they posses the necessary signaling.
Chapter four
CARRYING OUT ACTIVITIES RELATED TO WINTER SPORTS TRAININGS AND PRACTICES

Art. 10. In order to practice the profession of a ski/snowboard instructor on the territory of the ski area of Pamporovo Resort, the respective person shall have the necessary certification under Art. 146 of the Tourism Act. Ski instructors shall practice their profession only through the ski school in which they are employed.

Art. 11. (1) within the ski area of Pamporovo Resort, on days without competitions, the person under Art. 157, paragraph 1 of the Tourism Act may determine ski runs or sections thereof, which are to be used for practices with ski, snowboard and other similar equipment.

(2) The terrains provided for practices shall be marked as closed for tourists - users of ski and snowboard services, and the order for their use for the purposes under the previous paragraph shall be determined by the person in charge of the practice session.

(3) Individuals who are not given the respective permission by the person under paragraph 2 shall not pass trough and/or use these terrains in any way.

(4) The ban under the previous paragraph shall not apply to people and related to them motor vehicles, who realize activities related to the processing of the ski runs, the people participating in mountain rescue and/or medical activities.
Chapter five
CONTROL ON THE OBSERVANCE OF THE ORDER SET OUT IN THE SKI AREA OF PAMPOROVO RESORT. SKI PATROL.

Art. 12. (1) Control over the observance of the public order rules on the territory of the ski runs in the ski area of Pamporovo Resort shall be carried out by officials determined by the Mayor of Chepelare Municipality or the Mayor of Smolyan Municipality, together with ski patrols appointed by the owner of the facilities in the ski area - Pamporovo AD, in its capacity of a person under Art. 157, paragraph 1 of the Tourism Act, as well as by the bodies of the Ministry of Interior (ski police).

(2) The ski patrol consists from employees of the person under Art. 157, paragraph 1 of the Tourism act, who comply with the requirements of Art. 25, paragraph 2 of the Ordinance.

(3) The type of the distinctive uniform and the service card by which the ski patrol certifies its credentials when carrying out its official duties are shown on the information boards and on the Internet web page of the person under Art. 157, paragraph 1 of the Tourism act, together with the public order rules, the rules for safe conduct and the general terms and conditions for provision of services, as well as the rules for use of ski runs and rope-ways on the territory of the ski area in Pamporovo Resort.

Art. 13. On the territory of the ski area in Pamporovo Resort the ski patrol shall have the following obligations:

1. To conduct comprehensive control over the observance of these Public Order Rules, the general terms and conditions for provision of services and rules for use of ski runs and rope-ways of the person under Art. 157, paragraph 1 of the Tourism Act, and the rules for safe conduct of the tourists, both by the users of ski services on the territory of the ski area and the service staff on the same territory;

2. to control and asses daily, before opening for users of ski/snowboard services, the state of the ski runs and the conditions for practicing of winter sports in the ski area of Pamporovo Resort, incl. accessibility conditions of the slopes, suitability of the safety facilities (fencing, safety mats, etc.), the safety signs and boards, as well as their presence at designated locations, the presence of atypical hazards, avalanches and landslides, to send information to the staff servicing the ski area and to the management of the person under Art. 157, paragraph 1 of the Tourism Act, if it is necessary to take measures for the securing of the ski runs by replacing ineffective and/or placing additional safety nets, mats, signs and boards and/or by closing ski runs or parts thereof;

3. to control and asses the state of the ski runs and the conditions for practicing of winter sports in the ski area of Pamporovo Resort during working hours, to send information to the staff servicing the ski area and to the management of the person under Art. 157, paragraph 1 of the Tourism Act, if it is necessary to take measures for the securing and/or closing of ski runs or parts thereof;

4. In case of an accident and/or hazard, they shall notify immediately the management of the person under Art. 157, paragraph 1 of the Tourism Act and the staff servicing the ski area, and they shall give the obligatory instructions for tourist conduct in such situations;

5. to control the observance of the rules for use of the rope-ways servicing the ski runs in the ski area of Pamporovo Resort by the tourists;

6. to monitor and prevent the use of the ski runs and the rope-ways which service them in the ski area of Pamporovo Resort by individuals who behave inadequately, who are visibly under the influence of alcohol and/or other drugs;

7. to monitor and prevent the use of the ski runs and the rope-ways which service them in the ski area of Pamporovo Resort by persons who use them in a way that threatens their own health and safety, as well as the health and safety of other users of ski services;

8. To respond within the powers given to them by the applicable laws and regulations to all alerts given by tourists and/or the staff of the person under Art. 157, paragraph 1 of the Tourism Act which works in the ski area;

9. To monitor and prevent any unauthorized driving of vehicles, incl. snowmobiles, ATVs and bicycles along the ski runs in the ski area of Pamporovo Resort, with the exception of those, which are used by the person under Art. 157, paragraph 1 of the Tourism Act, for processing of ski runs, for ensuring the order and safety along the ski runs or in case of an emergency, as well as those which are used by the persons taking part in a mountain rescue and/or medical teams;

10. to monitor and prevent in the ski area of Pamporovo Resort any unauthorized ski/snowboard instruction by persons, who do not have the necessary certification and whose lift card does not include ski instructor credentials;

11. to assist people who have been hurt by securing the site of the accident and waiting for the arrival of the medical personnel and the rescue team;

12. if necessary, in case of any violations on the territory of the ski area of Pamporovo Resort, they shall inform immediately or seek assistance by the officials appointed by the mayors of Chepelare Municipality or Smolyan Municipality, including by the MoI bodies;

13. After stopping the facilities, to perform inspection whether there are any distressed people on the territory of the ski area in Pamporovo Resort.

Art. 14. The ski patrol shall have the following rights when performing their official duties:

1. to warn the persons who do not comply with the rules for safe conduct, the public order rules, as well as the general terms and conditions for provision of services and rules for use of the ski runs and rope-ways of the person under Art. 157, paragraph 1 of the Tourism Act, in the ski area of Pamporovo Resort;

2. In the event of a failure to follow the warning given, they shall limit the access of the violators to the facilities which service the ski runs in the ski area of Pamporovo Resort by confiscating and deactivating the lift pass or in any other suitable way.

Art. 15. (1) In case of established violations, the ski patrol:

1. immediately confiscates and requests deactivation of the lift cards of the violators, for which they shall draft a protocol;

2. Restricts the use of the ski area by tourists who systematically fail to observe these Rules, the rules for safe conduct and the general terms and conditions for provision of services and rules for use of the ski runs and rope-ways of the person under Art. 157, paragraph 1 of the Tourism Act, who do not follow the instructions given by the staff, or through their actions threaten the public safety and break the public order.

(2) Each service user on the territory of the ski area of Pamporovo Resort shall be obliged to cooperate during an inspection by the ski patrol and to take into account their warnings and instructions.

(3) When establishing a violation, the ski patrol, together with representatives of the MoI bodies (ski police) shall have the right:

1. when making a check, to ask for the IDs of the persons being checked;

2. To inform immediately and seek assistance by the officials, who have been assigned by the Mayor of Smolyan Municipality or the Mayor of Chepelare Municipality, for the issuing of a ticket for the violation, in accordance with the order stipulated by the law.

ADMINISTRATIVE PENALTIES

Art. 18. (1) for breaking these Rules, the breaching individuals shall suffer a fine of 100 to 300 BGN and the sole traders and legal persons - a penalty of 500 to 1000 BGN.

(2) In case of a repeat offense and/or particularly serious cases, the fine imposed, respectively to the sole traders and legal persons - the penalty, shall be doubled and/or there shall be forfeiture in favor of the state of the belongings of the violator, which have served for the realization of the respective breach of these Rules.

(3) Breach of these Rules shall be certified by tickets, issued by the officials appointed by the Mayor of Chepelare Municipality or the Mayor of Smolyan Municipality.

(4) Based on these tickets, the Mayor of Chepelare Municipality or the Mayor of Smolyan Municipality shall issue penalty orders.

(5) Establishing the violations, issuance, appeal and implementation of the penalty orders shall follow the procedure provided for in the Administrative Violations and Penalties Act.
ADDITIONAL PROVISION

Under these Rules:

1. "Ski area" shall mean a mountain territory with specific borders, which includes ski runs of different difficulty and designation, the connections between them, the paths and passenger rope-ways.

2. "Ski run" shall mean a publicly accessible, defined and safeguarded mountain section, on which are offered and used tourist services related to the practicing of ski sports (alpine skiing, snowboard, cross-country).

3. "Drug" shall mean each substance, natural or synthetic, which is included in List I and List II of the Single Convention on Narcotic Drugs from 1961.

4. "Repeat" shall be an offense which is made within one year from the effective date of the penalty order, by which the violator was penalized for the same or another type of violation of these Rules.

5. "Particularly serious case" shall be the one where in view of the harmful effects and other aggravating circumstances which have occurred; the violation made reveals an extremely high degree of public danger of the offender.
TRANSITIONAL AND FINAL PROVISIONS

1. These Rules have been drafted in accordance with Art. 154, paragraph 2 of the Tourism Act and Art. 24, paragraph 1 of the Ordinance on the safety and information security of the ski slopes in the Republic Bulgaria and for determining the ski-slope and ski-area safety rules as well as the work of the ski patrols, adopted by Ministerial Decree №13/26.01.2015, herein referred to as "the Ordinance", and they have been approved by Order №477/16.12.2015 by the Mayor of Chepelare Municipality and by Order № RD - 1035/02.12.2016 by the Mayor of Smolyan Municipality.

2. Instructions for the interpretation and implementation of the Rules shall be given by the Mayor of Chepelare Municipality and the Mayor of Smolyan Municipality.

3. (1) These Rules shall become effective on 10.12.2016.

(2) These Rules shall be published on the official websites of Chepelare Municipality and Smolyan Municipality, at the ticket offices for sale of lift passes and tickets on the territory of Pamporovo Resort, at the Information Center of Pamporovo AD, at Hotel Perelik and on the official website of Pamporovo AD - www.pamporovo.me
